Terms and conditions

This English translation is provided for convenience. In case of any discrepancy, the Estonian version prevails.

1. Scope and validity of the terms and conditions

1.1 These general terms and conditions of ordering in the online shop of Kuresaar OÜ (hereinafter the Seller) (hereinafter the Terms) apply to all persons (hereinafter the Buyer) who use the www.kuresaar.com online shop (hereinafter the online shop) and order goods and services from the online shop (hereinafter the Goods), including by entering into a sales contract for the purchase of goods from the online shop (hereinafter the Sales Contract).

By accepting the Terms, the Buyer confirms that they have read the terms of the Sales Contract, agree to them and will comply with them.

2. Purchasing goods and placing an order in the online shop
2.1 The Goods that can be purchased from the online shop are those with an “Add to cart” link. The price and availability of Goods may change continuously and without prior notice. If the Buyer placed an order before the price of the Goods changed, the price valid at the time of the order applies.
Prices of goods are in euros.

2.2 The Seller has the right to withdraw from a Sales Contract concluded via the online shop and not to deliver the ordered Goods or provide the service in the following cases: the Goods are out of stock; the Goods have the “On order” status in the online shop and are out of stock; the price or characteristics of the Goods have been displayed incorrectly in the online shop due to a system error.

2.3 Shopping cart and placing an order

  • The quantity of Goods in the shopping cart can be changed. In the shopping cart you can also add products and services that go with the selected Goods by clicking the “Show matching products” button. To order Goods, you must choose a suitable delivery method. Details of the delivery method will be requested later on the order page. The online shop’s terms of purchase can be read and, by agreeing to them, acceptance is confirmed by ticking the box (“tick”) in front of the terms.
  • To confirm the order, the Buyer must click the “Place order” button, after which the Buyer is redirected to the payment method page, where a suitable payment method must be selected. The Buyer can also change the payment method in the final stage of the order. The Buyer’s details must be entered; if desired, the Buyer can register as a Kuresaar.com loyal customer. In the next step, the Buyer can choose the delivery method and click the “Next” button. The final choice of payment method required to confirm the Order and complete the purchase then appears. The Buyer can choose the payment method and pay for the purchase. The Buyer must be careful when placing the order, as the prompt and trouble-free delivery of the ordered products depends on it.
  • The Sales Contract is deemed concluded upon receipt of the amount payable according to the order confirmation in the bank account of Kuresaar OÜ, or from the moment the hire-purchase contract is signed. The Seller will not fulfil an unpaid order confirmation.

2.4 Payment for goods

  • Settlement is made in euros.
  • Goods can be paid for: via online banking (Swedbank, SEB, Nordea Pank, Danske Bank, LHV Pank via bank links).

The encrypted data communication channel with the banks ensures the security of the Buyer’s personal data and bank details. Representatives of Kuresaar OÜ have no access to the corresponding encrypted data.

2.5 Delivery and handover of products

Transport of the ordered Goods is carried out in accordance with the transport terms valid at the time the order was placed.
  • The maximum delivery time is 3-5 days.
  • Our main delivery partner is Itella Smartpost.
  • When placing an order, the Buyer should make sure that the contact details provided are correct in order to avoid delays and misunderstandings in the delivery of the Goods. Kuresaar OÜ and the courier company are not liable for delays in the delivery of the Goods or for any misunderstandings if the delay or misunderstanding is caused by inaccurate or incorrect information provided by the Buyer when placing the order.
  • The Goods are handed over only to the Buyer and against a delivery note. Before signing the delivery note, inspect the packaging of the Goods carefully; if the packaging is damaged, the Buyer must make a corresponding note on the delivery note. If the packaging is damaged, the Buyer may refuse to accept the consignment and/or notify kuresaar.com customer service immediately at info@kuresaar.com
  • The Goods are handed over to a third party if authorised (including where the Buyer has designated a third party as the recipient of the Goods in the order). The Seller may authorise third parties to deliver the Goods (including using a courier service).
  • If the Buyer does not collect the Goods within 14 (fourteen) days of the agreed date for receipt of the Goods, the Buyer is deemed to have breached the Sales Contract and not to want the Goods. The Seller has the right to unilaterally withdraw from the Sales Contract, claim compensation for damage (for example, storage costs of the goods) and set off the damage incurred by the Seller against the amounts prepaid by the Buyer.

2.6 Right of withdrawal

2.6.1 The Buyer has the right to withdraw from a Sales Contract concluded in the online shop within 14 days without giving any reason.
2.6.2 The withdrawal period expires 14 days after the day on which the Buyer, or a third party other than the carrier designated by the Buyer, takes physical possession of the Goods.

2.6.5 Withdrawal from the Sales Contract
a. In the event of withdrawal from the contract, Kuresaar OÜ will refund to the Buyer all payments received under the Sales Contract, including delivery costs (except for any additional costs arising from the Buyer’s choice of a delivery method other than the least expensive standard delivery method offered by Kuresaar OÜ), without undue delay and no later than 30 days from the day on which the Seller is informed of the Buyer’s decision to withdraw from the Sales Contract. b. Kuresaar OÜ will make these refunds using the same means of payment that the Buyer used for the payment, unless the Buyer has expressed a wish to use a different means of payment. The Buyer will not incur any fees or other costs as a result of such refunds. c. The Buyer must return the Goods to Kuresaar OÜ without undue delay and no later than 14 days from the day on which they informed Kuresaar OÜ of their withdrawal from the Sales Contract. The Goods may be returned to the Kuresaar shop. The deadline is met if the Buyer returns the Goods that are the subject of the Sales Contract before the 14-day period has expired. d. The Seller has the right to withhold refunds until the Seller has received back the Goods that are the subject of the Sales Contract or the Buyer has provided the Seller with proof of having sent back the Goods, whichever is the earlier. e. If the Buyer wishes to avoid compensating for any diminished value of the Goods, the Goods must be used and tried on only as would be possible in an ordinary shop, and the Goods must be returned in their original packaging and complete as originally supplied (including all items in the product packaging and any gifts associated with the Sales Contract). If the Buyer uses the Goods more than is necessary to establish the nature and suitability of the Goods, or does not return the Goods in their original packaging and complete as originally supplied, the Buyer is liable for the diminished value of the Goods. f. The direct costs of returning the Goods must be borne by the Buyer. g. If the Goods to be returned have deteriorated, the Buyer is liable for any diminished value of the Goods resulting from their use if the Buyer has used the Goods in a manner other than what is necessary to establish the nature, characteristics and functioning of the Goods. In order to establish the nature, characteristics and functioning of the Goods, the Buyer may handle and use them only in the way they would normally be permitted to do in a shop. h. If the Buyer has used or tried the returned Goods in a manner other than would normally be permitted in a shop, or has used the Goods more than is necessary to establish their nature, characteristics and functioning, the Buyer is liable for the diminished value of the Goods and the Seller has the right to deduct this amount from the purchase price to be refunded. If the Buyer does not agree with the diminished value indicated by the Seller, the Buyer has the right to consult an independent expert to determine it. The costs of the independent expert are borne by the party whose position proved unjustified. If it proves impossible to determine which party this is, the costs of the expert assessment are shared equally between the Buyer and the Seller. 2.7 Cancellation of the Sales Contract The Buyer has the right to cancel their order after paying for the Goods but before the Goods are delivered, without additional costs. To cancel the Sales Contract/Order, the Buyer must send a notice to that effect, together with the Sales Contract number, to info@kuresaar.com .
